When to apply for ILR - Entry into UK delayed by 3 months

Hi,

My situation:

HSMP Entry Clearance date: 05/12/2007
Date entered UK: 20/01/2008
Current Tier 1 Expiry date: 09/12/2012

Using the new published 3 month discretion rule, I can apply for ILR.

If I take 28 days before my current expiry date, I can apply on or after 11/11/2012. I have booked for a PEO appointment for 13/11/2012.

My question is when applying for ILR for cases of late entry into UK and entry falling within the 3 months of entry clearance date, is there any guideline on when can I apply for ILR? I have just taken 28 days based on the guideline for any normal ILR. Will that be okay? Will my application be accepted on my current PEO appointment date of 13/11/2012.

The guidelines on when you can apply for ILR, i.e. 28 days before your 5th anniversary remain the same irrespective of whether the concession applies to you or not. What differs is when your 5 year residency begins; i.e. 5th anniversary from date or entry vs. date of EC. In your case it would the latter as the 3 month concession would apply to you. You can apply 28 days before the 5th anniversary from 05/12/2007.

CoHabitation Documents for ILR SET (O)

Hi,

I am in the putting together my application for ILR. My question is co-habitation document. I have:

1. Mortgage Statements covering more than 2 years
2. Council Tax Statement for 2012-2013, 2009-2010. Cant find my 2011-2012 though. The one in 2009-2010 was sent to our home we bought and we have been living in that home ever since.
3. Land Registry Title document stating Me and my dependant as owners and dated in April 2010.

Additionally I can get
1. Individual Payslips stating the address
2. Individual Driver's license/Counterpart for individuals

Will the above be sufficient?

Hi shaekhs,
my situation is similar to your, where I am short of 3 month for 5 years. I am confused whethere to apply for another extension or ILR.
can you please forward the link you mentioned about the new guidelines.
I could not find same on UKBA.

ILR Checklist

Hi,

I have almost completed my ILR application preparation. Just a quick check with members of the forum to ensure nothing is missed. All documents in the order below:

1. Application filled - Signed, but yet to date them. Should the date be the date when I am in at PEO?
2. Proofs for Scored points in the application form - Salary
a. Employer Letter confirming employment dates and annual salary
b. Table of earnings extracted from 12 months of Payslips along with bank statement deposit date
c. 12 months payslip
d. 12 months bank statements - highlighting salary deposits
3. Proofs for Scored points in the application form - Education Qualification
a. N/A - As proved in past Tier 1 application.
4. Proofs for Scored points in the application form - Age & Continuos residence
a. Passport that contains the dates outside UK
5. Proofs for Scored points in the application form - UK experience
a. N/A. Proved above in point 2
6. Life in the UK Test
a. Pass certificate from LUK
7. Co-Habitation Documents
a. Land Registry document - Registered in mine and spouse names.
b. Mortgage Statement - Joint mortgage account
c. Council Tax - Awaiting duplicate statement for 2011-2012, rest in tact
8. Additional documents (In hand to be supplied if demanded)
a. Payslips of Spouse (printed copies not signed/sealed with company)
b. Spouse P60 for last year and P45 as just changed job (printed copies not signed/sealed with company)
c. Applicants 4 years P60

Will the Home office seek proof of ability to pay Mortgage? The salary paid into account is more than Mortgage but regular expenses come out of Spouse account. Will this be challenged? If challenged will spouse's payslip be sufficient?

I dont have any appointment confirmation letter but just an email stating an appointment is booked. Think that is sufficient. Pls advise if its not.

Anything else missed?

Hi Shaekhs,

I am going for my ILR next Tuesday 6th. So have not got the experience yet.

its sounds that you almost got everything together, however you might have forgotten:
1-your and your spouse police registration.
2-your Tier1 and HSMP letters, as few people mentioned that CW might ask about them.... does not make sense but just get it ready if available to you.
3-Also, its important to prepare absence table for the main applicant, stating how many days been outside UK in last 5 years, reason for trip, date of returning to UK.
Also do not forget to photocopy all stamped pages in your passport.

Finally got the ILR approved today. Awaiting for Biometrics card over the post now. Thanks everyone for the help and support.
