What do they check in reference- Tier2 Applications

Post by Sam123 » Fri Aug 13, 2004 1:45 pm

Hi Members

My employer has applied for a WP Tier2. They had a call from WP for the previous 3 employer references. I am just wondering what do they check in reference? Do they tele the employment history along with dates on WP Form?

If it does not match what are the consequences?

Thanks

Work Permits UK will verify all details submitted in respect of the application to ensure that the criteria is met in respect to education/skills, job description, salary and of course the employer being bonafide and protecting he resident labour market. Where things don't add up they can either ask for verification or deny the application outright - they seem uncertain about your claimed work experience. Do you believe they should not be concerned?

I was on WP already this is a new employer. I have worked on P/T basis to an agency before starting my last official last work. Because I started my job last year on 1st Sept03 and P/T started on 1March 03. I did not declare about P/T work in my WP Application.

Somewhat lost as to your work history in relation to WP application - could you list it for my understanding i.e.

Date X- Y, Company A, part time etc

Even more confused - lets start again.

It appears that the employer sponsoring your work permit has been asked by WPUK to submit references from your last three employers presumably as this covers the period you are claiming to have acquired experience for the job in question. Are these references available? If you claim to have experience from the part time job then it must too have a reference.

Hope that helps

Thanks Kayalami for your responses and sorry for the confusion.

My previous WP applications was TIER1 but this one is on TIER2, so WP Team has asked my employer to send 3 previous references. My only problem is that I did some part time (paid tax and NI) work before starting my actual work last year and I did not disclose to this employer that I was also doing some P/T work because my actual job started on 1st Sept. Just to survive I did this P/T job because employer could not offered me job before Sept 03, but WP was granted in April03 for this job.

And this (P/T employer) happens to be one of my three employer, he is also sending reference about this latest job which I finished with him in (March-August) last year. He is not mentioning in reference letter about the very first job which I did for him.

I am worried if they match these dates- I wil be in deep trouble. Or shall I withdraw this application altogether.

Kindest Regards

It looks strange to me. Provided that you have an academic degree, work experience is unnecessary to fulfil the WP criteria.

I have masters degree as well, but it is one of the tick list on TIER2 application on WP FORM - previous reference, if applicable.

Hvae they asked anyone in the past to send reference in tier 2 application if not sent in the first time. Or this is a unusual case.

sam 123,

Must be a Friday afternoon thing cos I'm still not entirely clear. Couple of things to clarify.

Going from Tier 1/ Tier 2 WP to Tier 2 WP is normally treated as Tier 1 application unless new job is different to previous job. I am unable to tell from your post whether you are actually currently working. Could you list the following:

In 2001 I worked for company A as a B and this was full time.

In 2002 I worked for company C as a D and this was full time.

Still in 2002 I worked for company E as a F part time etc.

I now work as G for company H on a full time basis etc.

As per tnavon's comments you would normally satisfy experience/ skills factor by having a UK equivalent degree making the matter of employment references moot - I can only assume WPUK have evaluated your masters as not meeting this standards. Where was it from?

An initial concern is your P/T work was during a period where you were not in your F/T occupation on which basis a WP was issued. There are chunks of pertinent info missing out of your post - I need to know these to address your Q.

However note that WPUK have the right to ask for any documentation they deem necessary to decide your case.

In 2001 I was a student and working P/T for company A as a Technical support advisor till August 2002.

In August 2002 WP was issued on Tier1 teaching post in a school.

In March 2003 finished this teaching post and back to company A - P/T work, (Technical support advisor ) another school C applied for WP tier 1 in April- granted, but stared work in Sept2003 and still employed by school C (11-18years old).until end of this month (contract will finish 31st August 2004.

Now the new employer is a sixth form college and the post is to teach to (16-18years old) pupils similar job really but they said it is not a compulsory education in England under shortage skills so will not consider under tier 1 application. My Masters degree is from UK.
