Tax Returns question

Tax Returns question

My husband is applying for HSMP, he is providing the following three evidences for the earnings:

Letter from employer.
Payment slips.
Bank statements.

Is this ok, or he MUST provide Tax Returns? He is an out of country applicant and there is a tax system where we live.

You must provide whatever tax returns you have availible. Even if they only cover a few mints of the period claimed.

Ensure all documents that could possibly be viewed as copies are stamped and signed by the employer, preferably with the official designation of the signatory

would anyone please clarify my understanding that the tax returns that one needs to present to HO is the form issued by the employer to the employee detailing his tax deductions for the year.. right?

The tax system in Hungary is different... employer submits employee's tax returns electronically to the government every May for the previous calendar year. Therefore, the tax returns that I have is a signed printout of the employer's payroll financial system... would that be ok? there is no other form as the tax returns are submitted to the government electronically.

I have two options:

1- Claiming points for the period Jan 06 to Dec 06 with no tax returns to cover this period or part of it since the tax returns for this calendar year will be submitted in May 07. Would that be acceptable by the HO?

2- Claim points for the period Dec 05 to Nov 06 and present the tax returns for the calendar year 2005 which would only cover one month (Dec 05).

What do you think?

Whatever you do ensure you tick the exceptional circumstances box and state the reason that you can't provide a tax return to cover the entire period. I would include the previous year's tax document and make it clear that it relates to the previous year only - just because HO seems to be suspicious of applications with no tax documents at all. I would still claim points for the most recent 12 month's salary though as I think that's what the requirements state.

lot of people applying for hsmp does not have tax return for the claim period.the only thing you can do is...
1.go for the exceptional evidence.
2.even if you go for exceptional evidence dont forget to show your IT return.It doent matter even if its having one month of the claim period.
And with the return attach your explainatory note in details....your financial year...start and end date. No. of months in the return...for which you have claimed for...complete computation..if possible from a C.A
Just guide the caseworker on every step..if possbile..

Thank you guys.. shockboy, the tax office does not send any information back but can issue a tax confirmation letter including gross salary and tax deductions for the year (2005) upon request. What are the chances with such letter? It does not detail salary month by month but total gross for the year.

The tax confirmation from the It dept wouldcertainly hep ... though not mentioned in the checklist ... please mention this on the cover page ...
