ILR Roadmap (Applied for Fiancée Visa before 9th July)

Hi All,

We applied for a Fiancée Visa outside the UK before 9th July 2012 and this was granted in August. We are now looking at the FLR(M) and ILR routes. Am I right in thinking that because we applied for the Fiancée Visa before the new rules came into force that we will be able to apply for ILR after 2 years under the old rules even though our Fiancée Visa was granted after 9th July?

So I have been doing some more reading on this. All of the evidence available shows that we will still be considered under the old rules, as confirmed by Lucapooka. So we should have 2 years under FLR(M) and then can apply for ILR as long as my wife has passed the Life in the UK Test and obtained a B1 rated English qualification. One question still remains. The guidance notes for FLR(M) state:
Shortly before the end of your probationary period, you can apply for permission to settle permanently in the UK
What is considered to be "shortly before"? I will be looking to book a PEO appointment in the future and want to allow plenty of time to secure this

It's no earlier than 28 days


Please do not send us your application more than 28 days before the end of your 2-year qualifying period. If you do, we may refuse your application and we will not refund the fee. However, you must apply before your current permission to remain in the UK ends.
