Set Protection Route and letter from DWP

Hello forum members,

A friend of mine told me about this website and how useful and informative it is.Well, I just posted my set protection application through my solicitor for Indefinite leave to remain (refugee)Application posted 2 days ago.I received a letter from the Department for work and pension they letter states" we are reviewing your entitlement to benefit and need to see evidence of your exisiting immigration status document, you must ensure we receive your response within 28 days from the date of this letter or your benefit payment will be suspended" Has anybody come across such letter? and what actions did you take to resolve this problem with the DWP? letter also stated that I should email the border agency about details about my immigration status.Can you please advise on this? I'm also working and don't know what will happened next,got 2 kids and a partner...
Sorry for the long post....just so worried and dont know where to put my head.

hi, i've just received the same letter today. I don't really know what to do. Did u sort out yours?

I thought I'd seen that phrasing before: it is part of the new crackdown on benefit fraud, and you two are some of the 19,269 people under scrutiny (only the first tranche). According to The Telegraph: "They will receive a letter from the Department for Work and Pensions (DWP) telling them to send back a photocopy of their passport or residence permit within 28 days. If they cannot, they must email the UK Border Agency (UKBA) with a range of identifying information." Doesn't seem unreasonable - send them a copy of your documents and you are good. UKBA/DWP even seem to include pre-paid envelopes - unusually generous of them.

thanks for your reply. The things is that i've sent all my document to ukba set protection route nearly 2month ago,and no repky yet.Shall i write an email to ukba or call dwp.

I would just send DWP a copy of the application which you have earlier sent to UKBA (I hope you made a copy, like UKBA advises all applicants to do?). Mention that they hold your documents. DWP and UKBA can then internally exchange data and confirm your status. In any case, it is important that you keep the 28 day-deadline.

Have you received an acknowledgment letter from ukba yet?

When does your leave expire?

Have you kept a copy of your residence permit?

my leave expire on 6 of october 2012 , no letter from ukba yet. Yes i have copy of my previous llr

Send a copy of your previous residence permit and evidence you have submitted an in time application to ukba.

Hi Mirna,
I sent the dwp a copy of my visa which had 3 weeks to expire and a letter from my solicitor explaining that i still have leave to remain until the home office makes a decision even after my visa has expired.The letter states that I have 28 days to reply,and the 28 days has now expired haven't heard anything from them.which means that im fine.I also emailed ukba as the letter states if there is nothing and the check is fine.There would be no further reminder.I would advise you to see your solicitor and draft a letter send this letter along with your expired visa(photocopy) and you should be fine.

Isn't it dwp who have written to you? Why are you Emailing ukba?

I choose to email UKBA in case DWP doesn't get the letter or if it gets lost in the post ,UKBA can validate my status and contact DWP,they both work together on this matter, also i don't see no harm in doing so.

Ukba won't contact dwp of their own accord just because you email them. Make sure you send the letter to dwp by recorded post.
