ILR options for my wife

ILR options for my wife

Hi Guys,

I need some help to plan my ILR application date.

My visa history

HSMP granted - 27th Dec 2007
Entry in to the UK - 30th Apr 2008
Extended as a Tier 1 general valid till - 27th Dec 2012
Extended again as a Tier 1 general valid till - 27th Dec 2014 (This was to fill falling short of 4 months for ILR)

My Wife's visa status

Entered UK as a Tier 1 Dependant - 26th Jan 2011
Current Tier 1 dependant valid till - 27th Dec 2014

We both are eligible for ILR by 30th Mar 2013 but we are planning to send my wife back home (India) some time in Jan 2013 for delivery.

So we are slightly confused when to apply for our ILR.

here are my questions/options. please advice

1. Can I apply ILR for myself and apply child settlement for the would be born baby in India? can my wife travel back to the UK with her valid tier 1 ?

2. Can I apply spouse visa for my wife, child settlement for the baby and
apply ILR for both of them immediately coming back to the UK? this costs more money though. if this is an option to go with, what would be the process to get BC for myself and baby after 1 year from ILR?

3. Should I my ILR as well and apply all together after my wife and baby come to the UK? child wil enter the UK as a Tier 1 dependant.

Really appreciate your help.

1. Yes. Yes.
2. Don't even think about it.
3. Best option, if you are in no hurry to get settled status.

Thanks a lot sushdmehta for your reply. Just to be clear

If I go with option 1,

* I can apply ILR for myself in Mar 2013
* apply ILR dependant child visa for the baby in India
* my wife can come back to UK with her Tier 1 dependant.

If so,

* my wife and child can apply ILR as soon as they can come in

Or

* can I skip my wife's ILR and get BC for my child as soon as i get naturalisation (after 1 year from ILR. i.e some time in 2014).

if the above options are not feasible then i will postpone my ILR and go with option 3. (i.e we all 3 will go for ILR after wife and child come to the UK)

The child with entry clearance as child of a settled person will be eligible for settlement only after the other parent has also been granted settlement.

Doesn't make sense. What does your wife skipping ILR have to do with your child's eligibility to register as a British citizen?
