OCI for british child with Indian parents

OCI for british child with Indian parents

Hi All,

I am due for ILR in a months time, my UK born kid would then be eligible to register as a british citizen using the MN1 form. Subsequently we will apply for her passport. We will only be eligible to register ourselves as british citizens end of next year.

Now we might need to visit India sometime next year, so we will need either take an OCI card for her or a PIO card.

From what I read, OCI card is a way better offering than the PIO card, but would she be eligible for OCI while we are on ILR?

If we do have to go and she can only get PIO card, will we be able to convert that to an OCI card when we become british citizens?

Please advise how to deal with this whole rigmarole, thanks!

minor cannot apply for OCI unless accompanied by adult applying for OCI so OCI for the baby before any of the parents applying is out of question.

Other option you have is to take a tourist visa for her to visit India as you would subsequently be applying for OCI once you get your naturalization. There is no point spending money on PIO for just a single visit.

Anything specific that makes you wonder? if you have Indian passport currently then I see no issues you getting OCI.

Thanks Manyaonisland, no particular reason, just being a bit paranoid. Dont want any surprises in my ILR -> BC -> OCI plan.

It says:

Foreign born children of both Indian citizen parents POI - eligible, OCI - not eligible.

I guess, for Indian citizen parents who are now British citizen this may not be applicable.

this is when it comes to applying as individual application and not along with parent application. See the section Eligibility Criteria here

Also, I had same situation like you. baby born in UK while we were not having ILR. Now we are British Citizen and I applied for OCI for all of us together. No issues what so ever!
