EEA2 urgently

hi everyone,
I'm a portuguese living in UK for 8 years,wanting to marry my boyfriend,who has just graduated,looking for a job.At the moment i am on jobseekers allowance,plus housing benefit.We intend to apply for the EEA2 but,we would like to know whether it would be safe to apply under these conditions.Also,we have just moved to Birmingham,therefore,we still have no utility bills in our names,or even council tax bill.any useful advise,anyone?Thanks in advance.

- What have you been doing in the UK for 8 years? Have you worked for a continuous 5 years and obtained PR status by doing so?

I have actually been in and out of work,like temporary thing,really.And well,i was actualy planning to apply as a married couple,and no,we haven't been living togheter for 2 years,as we just got togheter now.

You could apply for EEA2 now as long as you have some proof of residence in your name (e.g. bank statements). It's not essential that they show your current address if you have just moved. It's mainly to prove that you have been living somewhere in the UK.

You would, however, make your application more straightforward if you can get some kind of employment, even if it's just an ongoing temp job for a few weeks. The UKBA tends to ask fewer questions if you can show that you are applying with employed status. You can also apply as a jobseeker, but you'd need to show various evidence for that to convince the UKBA that you are looking for work and have a genuine chance of being employed (refer to the document checklist in the back of form EEA2 for more details).

Thank you!But i was also thinking about the possibility of marrying my boyfriend abroad (outside the UK),preferently,in my home country (Portugal) or even in France.would the marriage certificate be valid in UK,to still apply for EEA???
