Family application for BC with only one parent, possible?

Post by ivepha » Thu Nov 15, 2012 2:36 am

Hi, I would like to know my eligiblility to register as a BC. I am 17 years old, born outside uk to non-British parents. My parents and I moved to UK 10 years ago and became ILR 7 years ago. Now my father is applying for naturalisation as a BC and wants me to register at the same time as a family application. My mother agrees on my application, but she does not want to be naturalised at this time. I am wondering if I am eligible to be registered as BC with only my father's naturalisation as a family application? If yes, should I be in section 3(1)?
Thank you very much for your help.

You may apply for registration as a British citizen at the same time as your father applies for naturalisation.

Yes, under section 3(1).

Thanks for the reply. My concern is in the following paragraph quoted from the MN1 guide. It says "......ONLY IF BOTH PARENTS are granted...." and the next sentence saying "if one parent holds British citizenship and the other is settled in the UK" , whereas in my case, one parent is applying for citizenship and the other is settled. Does this mean that if my father is granted on this application, he will be treated as the one parent holding British citizenship?

Quote MN1 guide: "Children in this category will be considered at the Home Secretary’s discretion and will usually be registered only if both the parents are granted or already hold British citizenship, or if one parent holds British citizenship and the other is settled in the UK."
