PBS dependant or spouse visa under FLR(M) ?

PBS dependant or spouse visa under FLR(M) ?

Hello All,

I have read some past posts. It seems that some people applied for PBS dependent instead of using form FLR(M), so I am wondering which one should I apply for.

Here is the a little summary of my visa status.

I am holding Tier1 visa and will be expiring very soon. My husband held Tier 1 visa before and became ILR couple months ago. Since I have issue to extend my own Tier 1 visa, we decided to apply for the spouse visa.

In my case, can I apply for the visa as PBS dependant or I should use FLR(M) ? I knew that under new rule, I need to wait for 5 years to apply ILR under spouse visa and 3 years under PBS dependant vsia. Beside this, is there any big difference between those two visa, or any restrictions for PBS dependant visa ? And can I use the document I prepared for FLR (M) to apply for PBS dependant visa ?

Just wanted to make sure...so actually the only option I have is to use FLR(M) to apply as spouse visa, beside apply for my Tier 1 visa extension, and I am not qualified to apply for PBS dependant, right ?
