HSMP to Spouse visa

HSMP to Spouse visa

Im currently in the UK on a HSMP work Visa. My initial 3 years expire Mar 2013. However I have been married to a British citizen for almost 1yr and half. I have 2 options:

1 - Extend my HSMP visa for another 2 years and then apply for naturalisation or

2 - Change my HSMP visa to spouse visa.

My question is if I change from HSMP to spouse visa, does my residential qualifying period start all over again? If so how many more years do I have to wait for naturalisation. Is extending my HSMP visa my best option time wise?

1. Yes your residential period starts again.
2. You would have to spend 5 years in this category before being able to apply for ilr. Note you cannot apply for naturalisation until you have ilr.

So would you say that it would be quicker to get ILR if I extend my HSMP visa?

Yes I would say that, because 2 is smaller number than 5, and when applied to periods of time it would follow that a period of 2 years would be shorter in length than a period of 5 years.

Is it 2years or 5yrs after I get spouse visa that i can apply for ILR?

It's 6:10 where I live but I guess we are not able to tell you the time of day in your location.
