Re: BRP

Post by APAN DESAI » Thu Nov 22, 2012 10:51 pm

I have applied for Tier 2 General (skill worker) extension visa and got my BRP card today which means successful extension application.

I have following query.
My first work permit period between 10/05/2010 and 11/11/2012

My extension (current) period between 17/11/2012 and 11/11/2014

If I count total duration of my leave, it is 4 years 6 months. I strongly believe that there is mistake in work permit. Or is there anything else? I am going to contact UKBA ASAP.
There is gap of 6 days as well between my two work permit. It also proves that there is no continuous 5 year of time.
However I like to know your review as well.I wish to apply for ILR. Am I eligible for it?

Thanking you and looking forward for your kind reply,

1. The period of grant under Tier 2 depends on the period of sponsorship, and is not 2/3 years by default.
2. The gap between issue date of current leave and expiry date of preceding leave doesn't necessarily mean a "gap in leave". Leave is granted from the date of decision and such gap in dates can exist. IF you made a valid, in-time application, there is nothing to worry about regarding this gap between date of expiry of previous leave and issue date of new leave.

Hi,
Thanks for your quick reply. Can I apply for the extension again in 2014 for six months?

Sure, all you need is a CoS .. just as for the extension you have just been granted ... and that you fulfil the other requirements for extension on the date of such application.

Thank you very much once again.
(1)Am I eligible for ILR after that?
If not, could I reuquest my HR and extend sponsorship period in 10 days so UKBA could extend six month further?

(2)If it is late, I would like to change employer. In this case am I eligible for ILR after changing sponsor?

Your help is much appreciated.
