When can I apply for ILR

Hi,
Request your help in understanding when I am eligible to apply for ILR.

Relevant dates are given below:

1. Entry to UK Tier2(ICT) - 17 Feb 2009
2. Left UK to India on payroll transfer - 21 Feb 2010
( Indian entity employee from 22 Feb 2010 to 17 May 2010 which is less than 90 days)
3. Back to UK on Tier2(ICT) - 18 May 2010 (granted on 7th May 2010)
4. Applied for Tier1 ( 19 Nov 2010)
5. Received Tier 1 visa valid from 17 Jan 2011 to 17 Jan 2013

When i look at the below link:

It says I should meet 5 requirements to apply for settlement. I understand the requirements 1,3,4 and 5.

The second requirement says:

You must have spent a continuous residence period of 5 years here in any combination of the following immigration categories:
- Tier 1 (General)
- Highly Skilled Migrant Programme
- work permit holder
- innovator
- self-employed lawyer
- writer, composer or artist
- Tier 2 (General)
- Tier 2 (Minister of religion)
- Tier 2 (Sportsperson)
- Tier 2 (Intra company transfer), if your permission was granted under the Immigration Rules in place before 6 April 2010

My first Tier2(ICT) was before 6th APril 2010 and the second Tier2(ICT) is after 6 April 2010.
So, When can I apply for ILR?
