Tier 1 (Exceptional Talent): initial application

Hi there,

I would be appreciate you for your opinion about three aspects of initial applications for Tier 1 (Exceptional Talent), in particular:
- geographical location of the applicant
- ability to apply;
- list of publications.

Question 1
I am in the UK now and want to apply initially. Is it permitted?
After I have read some discussions about Tier 1 Exceptional Talent, i.e. http://www.immigrationboards.com/viewto ... 914#586799
I suppose that just applicant from outside UK can apply initially.
Is it correct?

Question 2
I have Tier 4 (General).
However, due to famous clauses:

23. You are allowed to make an application in the UK (including switching from one immigration category to another) if you are here with permission to stay as:
• a Tier 1 (Exceptional Talent) Migrant;
• a Tier 2 (General) Migrant; or
• a Tier 5 (Temporary Worker) Migrant, sponsored in the Government Authorised Exchange sub-category in an exchange scheme for sponsored researchers.
24. There is no provision in the Immigration Rules for a person already in the UK in another category of stay to switch in-country into the Tier 1 (Exceptional Talent) category.

I see that holders of Tier 4 (General) do not have rights to apply for Tier 1 (Exceptional Talent)
Is it correct?

Question 3
There is requirement about 10 publications. I have required amount of my published articles but only in national journals inside my native country.
Does anyone know any details about requirements on publications?

There is much more required than just 10 articles published.

Once (if) you get the endorsement required you will need to apply for entry from outside the UK.

It makes sense, sort of, that Tier 4 students are not able to apply in the UK because the requirements mean the person will have had to be working inside or outside the UK as far as I can see.

I really think your best point of call initially would be the competent body you are going to apply to. I am curious what field you are a world leader or potential world leader in!!!

Thank you very-very much for your rapid reply.

Of course, I have read about all the diversity of the documents (I mean letters of recommendation from eminent person, organisation, which works in the field of my specialisation and evidence from my National Academy of Science about my achievements and my statement in 7000 words).
But I decided not to overload you with non-relevant information to my previous question.
You know - the text of the Guidelines is very clear generally. However, when you try to clarify some aspects for yourself they look like very complicated.

My Designated Body is The British Academy and I would like to apply as an Exceptional Talent.

I have my undefended PhD in Law in my native country (plus four year legal experience there) and consider that it is appropriate for this application since they want "Have a PhD or equivalent research experience". However, it is also unclear...
Also now I am applying for some Grant schemes due to their requirement about some scientific awards.

PaperPusher, what do you think about my case as a guru in immigration questions?

I got the guru status because of the number of posts I have made.

It will not be me you have to convince, but the Royal Academy. As far as I can see they are looking to endorse truly exceptional people. Are you already producing truly exceptional work or do you have potential to be a world leader in your field?

I don't think this is a route many people qualify for, for obvious reasons. When the government said they wanted to reduce net migration some people pointed out that the UK should still try to attract talented people, hence this route.

Thanks for your reply and for explanations about "Guru status".

I have read the purposes of the "Exceptional Talent Scheme" so understand them... However, in every case, it is very difficult to assess the talent of person without any examples. I have not already produced truly exceptional work but the Exceptional Promise does not require it.

In Q2 2012 UKBA issued just 32 visas for this scheme hence I understand that it has much more higher standards than any other type (for comparison they issued over 11.000 Post-Study Visas).
So it is very difficult to find any info about this application.
Therefore, I ask Forum about the experience of applying for Exceptional Talent.
