what exactly constitutes a criminal offence?

what exactly constitutes a criminal offence?

are there guidelines anywhere of what constitutes a criminal offence? is it if you are arrested? fined? i have a misdemeanor, but the penalty was just a fine and probation...do i need to disclose this? does anyone know what kind of background checks are conducted?

How long ago were you convicted of the offence? And incidentally, what did you do, leading to the conviction?

it was 8 and a half years ago for misdemeanor stealing when i was 17...im now completing my mba from a top university.
