Tier 2 holder, Can I apply under 10yrs rule?

I've been in WP + Tier 2 for 10 yrs. Once there was an appeal on my visa renewal which I went on and there was a gap for 4 months(didn't leave the country). Another time I was under UKBA grace period for 5 months, then obtained a new visa.

All the time I made the in-country application and have been here for 10 yrs under Work Permit and Tier2.

Since I'm in Tier2, can I still be allowed to use 10yr ILR scheme?

(Due to those gaps, I prefer to go with 10yr rule.)

Yes, if you qualify, meet all the requirements and if you so choose to.
