how do i represent myself in court without a barrister

Post by teetee4Z » Fri Dec 07, 2012 3:46 pm

hi guys, i am non-eu married to an austrian man, i applied for RC and was refused, reason was that they called my husband place of work and there was no response so they are not convinced he is exercising treaty right.

secondly the marriage is a proxy one and they do not accept proxy marriages from nigeria which is where i am from.

so my solicitor filled for an appeal based on the fact my husband's employer wrote a letter to clearify that since they moved office they had a new contact number which he supplied in the new pay slips and also the letterhead of his letter, he also informed them that the new number has been updated in company house and he can now be reached on it.
secondly we now have a 8weeks old baby which qualifies us for durable rship.

so my dilema now is that my appeal hearing date is 11/12/2012 which is 4 days from now and my solicitor has just informed me that he cant represent me at hearing because i have not paid my outstanding legal fees, i cant afford the fees right now so i need advice on how to go on without legal representation? i do not think he has even sent the appeal bundle, pls help ASAP.

what is your marriage certificate like is it civil/ customary marriage certificate if customary marriage certificate ie not bearing the nigerian marriage act then you will win the appeal . mine was refused but my appeal was allowed by the immigration judge.

check home nigeria coi report from ukba paragraph 24.19 states although proxy marriages are not allowed under civil law they are recognized under customary law

for her paylips the reason you/solicitor gave is ok if you present your case well you will win it . am from 9ja aswell

yeah i went with A SOLICITOR but believe me did not do much he just presented the case the the judge started to interrogate me be prepared to answer questions with regards to your reason for refusal and the contents of your appeal bundle

if i didnt go with him i will still win the appeal but it is good to go with a solicitor .
