Spouse visa overstay: what next?

What happens if a person on a spouse visa overstays? Does it affect whether they can apply for FLR or ILR once they have been married and in the UK 2 years? Or is it a case of having to make an out-of-country application?

Lots of questions... I can't quite draw the answers from the IND rules, which seem to suggest that not overstaying is NOT a pre-condition for spousal ILR (although it is for FLR).
