Family Visit Visa (EXTENSION)

Hello,

I am enquiring about my wife, I am a British Citizen and she has a Family VISIT visa to UK. I am studying in Europe and as I am not working I cannot apply for EEA Visa.

She got her VISA in July 2012 for a full 6 months and it EXPIRES end of January 2013.

The problem is we will travel in 10 days to UK for Christmas break but she is 7 month pregnant.

I want he to have the baby in UK as thats the only way my child will be British Citizen as i got my citizenship by Decent.

I spoke to an adviser when I was in UK and he said to me just before her visa expires to apply for an FLR(o) Further to remain (other) as this will take a couple of months to evaluate and thus she will not be illegally overstaying her Visa. by the time they reply she would have had the baby, which will be a British Citizen. Then he said HUMAN RIGHTS rules apply as they cannot separate the mother from he Child.

Can you please Further Advise me on this information as I am really confused and would exremely appreciate it.

How long does it take to get a reply for this application and what happens if they reject?

As I would have already had the baby...

Please note that you might be requested to cover the hospital costs as a visitor is not entitled to have access to NHS services.
