SET(M) Dependant for ILR : Requirements

SET(M) Dependant for ILR : Requirements

Thanks to the brilliant gurus here, i got some reassuring responses confirming that I can apply directly for SET(M) when my wife completes her qualification period, rather than first switching to FLR(M) http://www.immigrationboards.com/viewtopic.php?t=111085

Its not time to apply and I'm wondering if someone could help with a few queries :

The exhaustive list of documents to supply (I'm contracting via my Pvt Ltd Co).

Is there any maintenance fund requirement for the dependant ILR via SET(M)

Can i supplement my salary with dividend vouchers to show evidence.

The wife is also appointed as Company Secretary in the Pvt Ltd co - does this count as 'Employment' ?

It also asks about the income for my wife - she is a share holder and in the company and receives dividends - the form asks for a monthly salary to be declared - will this be zero or do i need to reflect the dividends as some form of income ?

Any others hints / tips / experiences from folks who've recently been through the same experience would be accepted with gratitude.

Wife arrived in UK Dec 2010, still on Tier 1 dependant as she didn't qualify when I applied for ILR

On what basis did you get ilr?

I got my ILR based on Tier 1 PBS (5 yr route)

In that case your wife needs to complete set(o) not set(m )

Thanks for your response.

I've added details of my case. I'm already an ILR holder (granted July this year).

My wife has only just become eligible, so my understanding is that she will need to apply via SET(M) as the dependant of a spouse with ILR, rather than SET(O). Am I right in understanding this?

Thanks again Greenie. Can you please point me to the list of documents I would need for applying - is there any maintenance fund requirement?

I think the correct form is SET (M). I copy here the text from the UKBA website:

Form SET(M)
You can use form SET(M) to apply to settle here as the husband, wife, civil partner or unmarried/same-sex partner of a British citizen or someone who is settled here.

Set(m) requires the applicant to have been granted leave as the spouse/partner of a settled person under para 281 etc of the rules and to be applying for ilr under para 287 of the rules. The op's wife is applying for ilr under para 319e of the rules and therefore set(o) is the correct form.

Hi Greenie, in my case I got my ILR in June this year. At which time I had to transfer the status of my wife's visa from Tier 1 dependant to FLR(M).

She will be eligible to apply for ILR in April 2013.

Am I correct in saying that for her SET (M) is the form not SET (O)?

yes, because she switched on FLR(M) she needs to apply for ilr on set(m)
