extention for dependant

Post by salman140 » Wed Dec 12, 2012 11:42 pm

i have a couple of questions about my visa and about my depenent visa

i am on TIRE 1 general visa .and my five years are going to complete in MARCH 2013.. and my visa is going to expire in MARCH 2013 as well . I am going to apply for ILR ( indefinite stay ) ... apart from these ... my wife came to UK in June 2012 .she is on dependent visa( dependent on TIer 1 general) .... her visa is going to expire in the same month of MARCH 2013 .... she will have been in this country only about 9 months till March 2013 .. now the confusion is that ..when i will apply for my ILR then what visa application form would i need to use for my wife visa ?
please do Guide me in above mentioned queries .i shall be very great full to you for this act of kindness.

your early response will be highly appreciated

You can apply as a PBS Dependant if you meet the criteria set out in this guidance and the Immigration Rules, and you are:
• the spouse or partner of a person with indefinite leave to remain or British Citizenship who last held leave in Tier 1, 2, or 5 of the Points Based System and you do not yet qualify for indefinite leave to remain;
Source and the form is here

Stress a bit on the words in bold. you might find an answer.

Once you get your ILR, your partner can use the above mentioned form. However, If you are aiming to post your application (Which I'd prefer not to) then send a covering letter explaining that your application is outstanding and awaiting consideration.

My personal suggestion would be (bearing in mind the current backlogs) book PEO appointment. To get a second opinion you can always call 08706067766 and tell them your situation. May be there could be a shorter way to do this (with Single PEO Appointment).

that is mean ... i cannot send her visa form with my form ( as my form would b specifically to apply for IlR ) ??
if is that so .. then do i need to wait for my ILR to be granted and after that i shoul apply for her extention ?
but her visa is also going to expire on the same date on which mine visa is getting expired . so i think the time period which will take by my visa process .. in that period she will be illegal to live iin uk

UKBA wrote:The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed 90 days, it will not be counted as an absence.
