Salaried earnings – required evidence

Post by pb78 » Tue Feb 06, 2007 4:14 pm

I have a question specific to Q33 in the HSMP form "Income Tax return covering period claimed for:"

There have been multiple posts in the forum that talked about whether to tick the box pertaining Q33 or not and we have seen people giving us contradicting posts. I have posted this subject to clarify the doubts around this section by taking my example. All those successful HSMP applicants kindly respond.

MY CASE:
----------

I am from India and my earnings period that I intend to declare is Dec 2005 - Nov 2006. I have the Form 16 and Saral proofs for the Dec 05 - Mar 06 period, which obviously does not cover the entire 12 months period claimed for. I will be providing payslips for 12 months. Also as an exception case I will be providing my Bank statements for the 12 months period.

I could do one of the 2 as stated below. Kindly advice me.

1. Since I do not have tax proofs for the entire 12 months period, I will not tick the box for Q33 and under the exception case provide bank statements. Also mention in the box provided that I have submitted tax proofs for 4 months and the rationale behind it.

2. Since I do have tax proofs for 4 months, tick the box for Q33 and mention below that tax proofs are available for only 4 months. Also choose the exception and provide bank statements.

Looking forward to a clear understanding of the issue.

Thanks,
pb78

India Form16

Post by hsmp_distressed » Wed Feb 07, 2007 10:44 am

I have an exact similar situation. I have bank statements and salary slips from my employer explaining how much tax is deducted per month. My earnings period is jan-dec 06 and needless to say, in India you can have form16 only for jan-mar'06 timeframe. Has anyone been in similar situation?

I am in the same predicament, too.

May be successful applicants can throw some light.

Hi,

I choose the following for my application,

1. Since I do not have tax proofs for the entire 12 months period, I will not tick the box for Q33 and under the exception case provide bank statements. Also mention in the box provided that I have submitted tax proofs for 4 months and the rationale behind it.

Although my application was sucessful, I would sincerely suggest that you should follow...
1. Not ticking the IT returns box and provide a justification in the exceptional circumstances box.
2. Make sure you submit both Form16 and Saral Form and both documents stamped and signed.

Regards

Saral forms are not signed although they are stamped by IT.
Form 16 - do you mean signed and stamped by employer? I wonder if my previous employer would do it.

Thank you for your suggestion hsmp.applicant2007. You had stated that

Although my application was sucessful, I would sincerely suggest that you should follow...
1. Not ticking the IT returns box and provide a justification in the exceptional circumstances box.
2. Make sure you submit both Form16 and Saral Form and both documents stamped and signed.

I have a couple of questions for you.

1. Did you tick Q33? You mentioned that you were successful. Just wanted to know what you chose.

2. As mentioned by srikp Saral forms are not signed although they are stamped by IT. Were your Saral forms stamped and signed? If not did you provide any justification for your Saral with the ITO stamping?

Please clarify

Regards,

Hi,

1. No, I did not tick Q33.

2. I did not submit my saral form. I used my Form16, signed and stamped (as a duplicate) by my employers and used it as the evidence of exceptional circumstances, i.e. tax return not covering the entire earnings duration.

Regards.

Well as my understanding is ....
Saral are stamped and signed by the authority who collects it at the IT department. If you have done it thru a agent then may be you dont have a signature on it ....

Form 16 will not be signed again by any employer as ther can be only one Original Form 16 which is submitted to the IT department ..... SO FOrm 16 will always be a copy :-)

Hope this helps your query ...

I dont really agree with you as there are many cases these days getting rejected for not providing SARL and not having marked that you have provided SARAL ....

Well there would be no use if you provide your SARAL and dont mark it in the application as they will only consider that is marked in the application.

I would sincerly suggest you guys mark the option and provide the SARAL no matter how many month sit covers.

Also provide the Form 16 even if you are not able to get the duplicate marked by the employer ....

I submitted the returns personally - not through an agent - but I did not get any signature on it. Any chance of IT signing it now?

My current employer signed the Form16 duplicate but my previous employer isn't interested. So, may be, I should just be happy that I got atleast one!
