Tier 2 COS: RLMT and Shortage occupation

Post by Rahul_123 » Mon Dec 31, 2012 1:40 pm

Hi.
Below are my COS and job details, Please suggest me way ahead if some one has faced similar problems.

I am a Stress Engineer (Main job title) working in aerospace sector.

The exact SOC code is 2122 and my employer has assigned the COS with using this code and salary meets the requirements.

1) In COS, they also have mentioned that this job is in shortage occupation list. But when I have checked shortage occupation list, under SOC 2122, only 'MECHANICAL ENGINEER IN AEROSPACE SECTOR' comes under shortage occupation. My employer said, the stress engineer job is part mechanical engineer and we are aerospace sector. But I am worried now whether my COS is valid or not? because Home office may not understand these stuffs unless we explain them through sponsor note.
My question is: Is there any rule which says that to be eligible under shortage occupation, my job title must be same as in shortage occupation list. Please suggest.

2) One more thing is, I am on PSW visa and have been working for same company since Jan 2012. So exempted from the RLMT and that is why, my employer did not provide any details of RLMT in COS.
My question is: Should we provide the sponsor note to say why I am exempted from the RLMT.

Please suggest what should I do in this situation. I know that, it is employer responsibility to provide valid COS but as this is the first time they are assigning the COS, there are many chances of making mistakes in COS.
Many times tier 2 visa is refused due to mistakes in job title and COS details. So I am cross-checking the COS provided by employer and I need your suggestion to amend the COS through sponsor note.

Thanks in advance for your time and suggestion.

The job title in the SOC does not have to be the same as your job title within the company. It is the description of the job you are doing that should match the description in the CoS.

See para 216 of the T2 sponsor guidance:

It is important that you choose the SOC Code which contains the job description that best matches the role you want to recruit for even if the job title you use is different to the one in the Code of Practice.

IMHO if you are a stress engineer you can also be called a mechanical engineer or a structural engineer, your employer is right and you are worrying unnecessarily.

There is no need to remind UKBA that someoone switching from PSW to T2G does not need a RLMT - they made the rules.
