ILR query - 180 days***********

Hi Friends,

I would appreciate if someone can help me with teh below query.

I came to UK in May 2004 on student visa and I got my HSMP in May 2007 ( 2years) + Tier 1 General extension ( May 2009 - May 2012).

I was eligible to apply for ILR in May 2012 but I was out of UK for around 280 days and all were personal trips and vacation so I got another extension of Tier 1 General in May 2012 until May 2014.

As per new rules in dec 2012 - you can be out of UK for more than 180 days in total of 5 years. As none of my trips have been more than 90 days or 180 days in 1 years but my total out of UK is 280 days in total of 5 years

I have always been on contract job since 2007. Now in Feb 2012 I have opened my own Limited Company and doing contract through my limited company?

Can I apply for ILR now?

Please advise me.
