Hi,

Please help me to clearify this issue.

My wife came to Uk on student's dependent (wife) in septmeber 2007 and lived here continuously for more than 5 years now.

I got my ILR in November 2010 and British Citizenship in March 2012.

My wife swtiched to spouse visa in Dec 2010 and got her ILR in Dec 2012.

Can she apply for British Citizenship on the basis of 5 years (residential qualifying period)?

Can she be exempt from 12 months on ILR before Naturalisation application?

Does her stay here on Student's dependent + PSW dependent dependent counts toward residential qualify period?

All your help will be greatly appreciated.

She can apply for naturalisation now.

As a spouse of a British citizen, she only needs 3 years residency.

She does not have to wait one year on ILR to qualify.

Yes, She can apply now as spouse of British Citizens 3 years qualifying period. She is exempt from 12 months on ILR before BC application. Good luck.

Please could you let me know how to show her legal stay if Home Office has kept all previous BRP? Or we shouldn't be worried about providing evidence of her legal stay apart from her all original passports.

Can we attach photocopies of previous BRP?

You don't need to show previous history as HO already have BRP record and she got ILR. Just send all documents with application as mentioned in AN Form for BC Spouse.

Also we got married in Pakistan. Do we need to register our marriage here for BC application.

You don't need to register marriage as your wife already got ILR as spouse of BC. Pakistani wedding is OK.
