Living Partner Visa

Hi

I am planning to bring my girl friend to the UK. I have my P.R in the UK and I am Malaysian citizen.

She is a Malaysian citizen. and planning to study in the UK.
Background- She has been forced married in Malaysia 10 years ago where I was rejected by her parents due to my social status.

I believe the only way is to bring her to the UK as a student (as she also have intention to study ACCA) and then she can live with me there as a living partner and once we decide to marry she can go ahead and apply for divorce from the UK.

My question:
Can she come on student visa and can we then convert it to as a living partner visa after few months when she arrived in the UK?

From past experience can anyone please let me know what are the immigration requirement in particular the documentation requirement from her for converting to living partner visa ONLY (Photos, single status letter?? anything else. (Please don't send me the links to HO website- I have read it but to confusing)

Also how long will it take her to get the transfer to living partner?

I would be really greatful if people with experience of people who have gone through this situation please advice me.

The requirement for an unmarried partner visa is that you have lived in a relationship akin to marriage for 2 years. In practicality - it means residing together.

Have you done that?

I'm assuming not.

She can switch from a student visa to an unmarried partner visa - but only if you meet the requirements.

Your gf can come to the UK as a student and then switch into the unmarried partner category, but only after you have lived together for two years. To prove this you'll need evidence of bills and bank statements etc in both your names and going to the same address

This two year requirement doesn't apply to the spouse category, so if you were in a position to marry in the next two years, it might be possible to convert to a partner category more quickly.

For your gf to gain leave to remain in either the unmarried partner or spouse categories you'll also need to meet the minimum annual income requirement, which is currently £18,600.

The minimum of 2 years co-habitation is mandatory and Unmarried Partner Visas come under a great deal of scrutiny. If you find yourself in a position to apply for this in the future when you qualify, under current regulations you will have to show that you are earning a minimum of £18,600 per annum, with evidence of your finances..bank statements, pay slips etc. You will also be required to submit documents covering the 2 year co-habitation period proving joint address and that you have 'a relationship akin to marriage'. I know you're asking not to be given a link to the information on the UKBA website, but at some point you'll need to read through the regulations on form FLR(M) yourself.
