Tier1 dependant to ILR dependant for a child in India

Hi All,

My son(aged 2 years 6 months) was born in the UK and he is currently living in India at his grandparents house. A few days after he was born, I got him an Indian passport and made him dependent of my then UK Tier1(general) visa which is valid through 19th January 2013. Now, both myself and my wife acquired ILR and we would like to apply a dependent visa for my son from India to bring him to the UK.

I’ve sent an email to VFS India requesting them to help me finding the correct visa application form, The replied me as


We regret to inform you that neither VFS nor its staffs advise the applicant regarding the visa category and the supporting documents, kindly refer to the below mentioned link for more information.

I’ve come across an application form VAF4A at the above link but I’m not sure if that is the correct application form because of the following information at http://www.ukba.homeoffice.gov.uk/visas ... /children/

“ You cannot apply in the child category if you are the child of a person who is settled in the UK or has British citizenship if their most recent permission to stay was under tiers 1, 2, or 5 of the points-based system “

Could someone please help us finding out the correct application form(and appendix) in my son’s case.
