Non EU spouse travelling with UK citizen husband to France ?

Non EU spouse travelling with UK citizen husband to France ?

Hi all

I am a UK citizen and my wife lives with me in the UK. She is on a two year spouse visa after which she is eligible to apply for ILR. Her resident permit has my name on it as her spouse. We are planning to go to France in May. Does she need a french (schengen) visa when travelling with me ???

Yes she does. Visa free travel is possible only with an EEA Family Member permit. It must say those exact words on the permit.

It is weird, but you are better off being an EEA national living in the UK rather than a UK national ;) The applications to the home office are free of charge and you don't need visas to travel with your non-EEA spouse. Crazy, eh? :)

Thnaks icexxik. From reading this forum, i am lead to believe that though my wife requires a visa, it will be free of cost and she dont need to provide the usual documents like my payslips, employment letter etc etc. Our son will also be travelling with us who is a british national.

Am i right ?

Yes, I believe you are right. It is certainly true for non-UK, but EEA nationals and their non-EEA spouses. I am sure it is the same for spouses of UK nationals, as technically, UK nationals are EEA nationals as well.

The visa situation should hopefully change in the next year or two. UKBA is currently introducing EU-compliant residence cards for all non-EEA nationals resident in the UK under UK national laws.

In these circumstances the terms of the directive would apply and you can obtain a free-visa for your wife.
