held ILR before, can i get it back

held ILR before, can i get it back

Hi
My brother had held ILR before, on account of not returning to the UK has has lost it.
Now i just got my ILR, and on th eletter from the home office it reads
"If your absence from the UNited Kingdom is for longer than 2 years but you can deomnstrate that you had indefinite leave to enter or remain when yu last left, and you are returning for the purpose of settlement, yuo may still qualify for asmission as a returning resident, for example, you have maintained strong connections with this country.
"

Now, since i, his brother has ILR, he has a strong connection through me, and since he has held ILR before can he apply for ILR on these grounds.

Is it a borderline case, should i approach a lawyer?

I suggest you should involve a lawyer. I find it hard to believe the HO will recognise your brother as having strong ties to the UK through you. I must stress that it is difficult and rare to get an ILE (returning resident) status.

2. How old is he (to determine the proportion of his life that he was in the UK)?

3. What did he do in the UK - a work history can be useful.

4. What other ties apart from you (very weak tie) does he have in the UK i.e. wife/ partner, children, property etc.

5. What are his circumstances in your home country - is he seriously ill/ destitute with no other family round him etc.

It is difficult to get a returning resident visa but not impossible. Do seek competent legal advice on this as its strictly not DIY territory.

thanks for the advice

my brother has been here for a few years(2-3 years in total), that too in small chunks. we had got ILR since our parents had ILR. now they lost it too. can they apply for ILR, since their child has ILR. they are pretty old, past retirement.

he is 23 now. he is outside the UK, if he comes on a visit or student visa, can that help. if he studies here for a year or so and then works on that new student work permit, can that help.

he has no ties apart from me, but he can buy some property in the UK

he is hale and hearty with our parents with him.

I know it is not DIY territory, i was just trying to see if there is something i could do for him. if there is an outside chance and i know if there were any law firms i could approach, i woudl like to do that.
