Your questions are not really relevant at this point as you don't have even a basic understanding of the rules and requirements. Nor have you said if they are already in the UK on a valid immigration status. Take time to read the informaiton in these links and then ask about anything you don't specifically understand.

I've provided the relevant links for the spouse and children's applications. There is a lot to digest so I suggest you sit back and take in all of that information. Then, your questions will be focused and the answers easier for you to undertand in the context of the gaps in your knowledge base.

But I am stuck at the first point where it mention

You cannot apply in the child or partner category if you are the child of a person who is settled in the UK or has British citizenship if their most recent permission to stay was under tiers 1, 2, or 5 of the points-based system and:

So wondering do i come under tier 1 or not

As i got HSMP before tier 1 which is on june 2006

You stopped reading halfway (why?). It's the information that comes after the and: that is the relative clause.

Not it does say that. Go back and read it or take an appropriate eye exam.

Don't get angry Guru,

I just want to know if I come under the criteria of tier 1 or not I know if I don't have to go through dependant of PBS

You cannot apply in a partner category if you:

are the spouse or partner of a person who is settled in the UK or has British citizenship if their most recent permission to stay was under tiers 1, 2, or 5 of the points-based system; and
you do not qualify for settlement yet.

Instead, you must apply as a dependant under the relevant category of points-based system.

Got it guys the first paragraph is misleading - lot of discussion done on this forum

So I have to apply for spouse visa through VAF4

One more thing guys - I remember I have seen some where if you are married and your dependant is from out of UK and if its been 4 years you can apply for ILE
Is it still there?
