Hi sushdmehta and all,

I received a sentence from Magistrates court on Aug-2011 for driving without insurance. The sentence was: fine about £500 and 6 points. No custodial sentence.

I guess the spent period for my sentence is 5 years as per the rehabilitation act.

I am due to apply for ILR in Nov-2013 as I will be finishing 5 years.
But I am under an impression that I will not get ILR due to the unspent conviction I have.

Looking at the information given at http://www.immigrationboards.com/viewtopic.php?t=120784, I understand the unspent conviction clause is removed. It will be a big relief to me if this is the case.

Please could you shed some light on this.

is my understanding are correct ? if someone has 3 points or 6 points even from court, can apply for ILR or not ?

I had Fixed Penalty Notice IN10 driving without insurance, £200 Fine, 6 Points on my licence in April 2011 and got ILR in February 2012 without any problem. So don't worry and apply your ILR. Good luck.

did you receive the fine from court or from police ??

this is y .. i m sure if it was from court then you have to wait for 5 years.

but i m more concern about the new rules ??

with new rules do some one still need to wait for 5 years or just 2 years or nothing ?

please advise.
