My wife here in the UK on a Spouse settlement visa and due to apply for ILR soon Set (m). we have already spent few weeks outside of the UK for holidays, she is due to travel back to her country later this year before she apply for ILR but don't want to spend too long outside if it will effect this. Can someone tell me how many days your are allowed to spend outside the UK?

Time spent outside the UK
The Immigration Rules do not say that you must have been in the UK for the entire 5 (or 2 if under the transition rules) years of your visa or permission to remain. Your application to settle here will be judged on its merits, taking into account your reasons for travel, the length of your absences, and whether you and your partner travelled and lived together while you were outside the UK. If you have spent a limited time abroad in connection with your job, for example, this should not count against you.

Thank you for your prompt reply but my wife will be qualified after 2 years not the new 5 years rule. and she may stay out side of UK for 4 months is this will cause a problem when she applies for ILR??

If she applied for her visa before 9 July last year, she will qualify after 2 years. That's why I placed the additional information in brackets in my post). Why does she need to spend 4 months outside the UK. Is this for work, or compassionate reasons?

she will be visting her family back home as they would like to see our littlt daughter as well.

Hi guys,
I will apply in person for my wife ILR and I would like to know what's the best office which could deal with self employed cases as i will travel abroad straight after the appointment and I can't afford to leave my passport there for couple of weeks if they decide to do further inquires as usual for the self employed applications.
Also as alternative option , can I give them a certified copy of my passport and I will let the council check my wife application beforehand so, they may be able to give me a certified copy of my passport?
I really appreciate you thoughts.

As Cardiff and Liverpool ones are defo no for aelf employed cases I would suggest to go to Croydon alot of ppl are been accepted on same day at croydon if ur travel is that urgent cant you apply after ur travel or just delay your travel untill u have all documents back eventho if u have given decision on same day u still have to wait for brp and it could tale upto 2 weeks.

I am living in north east so I was thinking to go to Sheffield , I am not sure if they you will be processing my wife application quickly or not.
I am the sponsor for my wife's application so do I have to leave my passport there if they decided to do further inquires???

Settlement Checking Service (click) remeber that under the old rules there is no specific financial requirement so long as you can adequately maintain and accommodate yourselves that will suffice.
I assume she is not a PBS dep as you said she needs to apply SET(M), thus you already had ILR/British Citizenship prior to her spouse leave?

I assume you mean for income? If so, supply the last 3 months bank statements showing income from self employment and some proof you are self-employed, i.e. from HMRC or accountant.

If you're going to a PEO then just take the original passport as you should get it back on the same day.

So based on this post the new threshold of 18600 will apply on my wife's case since she will apply for a settlement visa of a settled person in UK using set(m) form. However ,if you read the last paragraph of the enclosed link:

They said "If you already have leave on the basis of being the spouse or partner of a settled person, you need to meet the current rules when you apply for settlement on this basis, not the new rules outlined above."
So i am still confused if my finicial rules will apply for my wife since she got her 2 years visa before july 2012.
