Please I came to the UK with HSMP with my spouse and two children in February 2006. As I was about to push in my application for the approval of FLR, the old HSMP rule was changed and I was negatively affected, as my earnings are not enough to give me the required minimum point of 75.

Meanwhile, sometime in August 2006, my wife applied to a College as a student to study Health Care for 1year programme and she has been given admission letter.

Meanwhile, our application for the renewal of our HSMP is still with the Home Office. My last discussion with my caseworker was that my application stands for refusal in view of the fact that my point was less than 75. Although, if the application is refused, i might file for appeal.

I would however want to know if my wife can process her student visa while i am still pursuing the issue of the HSMP (FLR), till the whole thing will be sorted out.

I will be glad if you can assist with your advice on how she could get the student visa and to provide us with any information that will be of help to us.
