Tier2 Intra company transfer query for self & working sp

Hello,

I work for an IT firm and planning to apply for Tier 2 Intracompany transfer-skilled worker from India. My wife is also working in another IT company.

1) Can you please tell me whether she can apply as a dependent although she has been working. Does she need to produce any documents from her employer? Please note that she is not planning to quit and will not travel immediately after getting visa. She will travel after 6 months intermittently on holidays.

2) I had been refused a Business visa 5 months ago on the grounds that I had stayed in the UK for 5 months on a business visa before that (whereas in the application I mentioned that I would stay for only 3 weeks) and they needed to know why I stayed there for 5 months (of course I stayed there due to official reasons). Please let me know if this previous business visa rejection will have any impact on the current Tier 2 application?
