Hi everybody
I Chrish working for an IT company as Support Analyst on PSW visa. My visa expires on FEB 23rd, my company applied for a license through a consultancy which is still pending
they are happy to sponsor me visa they are ready to hike my salary upto 23k
and change my role as Graduate Developer
but the thing is the consultancy said they could't forward this because i am not eligible to the that role as i am on PSW but it is my 1st development role after my graduation why i am not eligible for it??????????
the next role is system programmer where my company can't afford to it
i do have another query can i switch into Hardware engineer and apply what documents do i need for it???
please i do have only 10 days left to me help me

you need to call ukba and ignore your consultancy, you will get answer of your question, according to me you can switch from PSW to Tier2 for Graduate developer

You are not entitled to a graduate role because you have been working for more than 6 months. Graduate roles are intended for those without experience.
Also, your Soc code must be matched to the job that you actually perform. It is not a case where the company can pick and choose what code they want to assign by the salary. Instead, they need to carefully look at the job description. It is this job description that must match your role. If hardware engineer most closely matches what you do, then using that code should not be a problem if your salary is at or above this rate.

At present i am working just as a support analyst where i have't had hands on any development side i just give support to clients
now they are looking forward to send me to development side
as far as now i have't had experience as a programmer
so its a dilemma will i be able to apply for graduate developer

No - as I said this is only for people who graduated within the last 6 months. There is no dilemma.
If the job description for a hardware engineer matches your proposed role, that is great! Use hardware engineer. But if it doesn't and your company cannot match the required salary of whatever job it is that you are doing, you will have to consider alternative options, i.e. finding a new company or leaving the UK.

this is the job role description in ukba website there is no where described that graduated less then 6 months it says that 6 months less then commercial experience and recent graduate or degree related technology degree i have completed my graduation in 2010 july and switched to psw where we will be getting psw to search for a job and switch to another visa obvioulsy it will be a graduate developer role if it is my 1st job as a developer after my graduation without any experience can i raise that point

Read into it whatever you would like. However, you are not a NEW graduate and you have been working in IT. There is no place in the application where you can 'argue' your Cos. However, if they accept it, they accept it. If I were a caseworker I would be thinking you already had a PSW and you are not a new graduate.
Try it if you like. This is just the advice of a stranger on an immigration forum.

Please do not complicate issues for yourself. On the job description UKBA has stated that Graduate developers are classified as all programmers and developers who essentially have less than six months commercial experience of programming. This includes new

As long as you are a PSW holder, you are still a fresh graduate, at worst tell your company to give you a fresh employment as a Graduate Developer. The day you are employed as a Graduate developer is when you comercial experience starts as one. They haven't said commercial experience in the IT industry.
Do not have sleepless night on issues that are not worth it and don't complicate matters for yourself.
