My husband and i have been living legally in the UK for the past 4 years. My visa expired in jan 2012 so i applied for further leave to remain using the flr(o) form until my husbands visa expires in nov 2012. We waited and waited for the ukba to make a decision but they did not. Nov came and my husbsands visa expired so we immediately asked to withdraw my application since no decision had made. I have to mention that during my waiting period i had a baby. When the ukba finally returned our documents. In december, about two and half weeks after withdrawing the application, we discovered that i was refused the visa based on the fact that my husbands visa had expired and there was no grounds for granting me leave to remain. Our passports and marriage certificate were withheld and in the letters sent to us there was so explanation as to why or how we would go about retrieving them. On advice from our lawyer we bought a ticket early in january to fly back to our country towards the end of January as this was the most affordable ticket we could find. I must slso mention that this ticket was not changeable. We sent copies of the tickets and letter off to the Ukba to show proof that we were ready to leave. We however did not get any response from them so went several follow up letters but still no response. In our desperation we found the number for their sollihull office a few days to the day we were supposed to leave. To cut a long story short, we missed our flight and a week later we were served with overstayers form and have now been asked to be reporting to their local office. We are very distraught over this because it was for this same reason we withdrew the application in the first place so as not be classed as overstayers. We have now lost the money for our tickets, we have no jobs as we resigned our jobs over 2 months ago. The ukba claim that we have refused to leave the uk even though we have been the ones pursuing them for directions on what to do to leave on time. We would appreciate advice on what anyone thinks the best line of action should be.
