Need help with PBS Tier 2 Appendix 5 Please

Hi,

I am in process of preparing my visa application under Tier 2 General category. I have a few questions re Appendix 5 which I hope the experts on this form can help with. I am applying for myself, my wife and 2 children.

Q1. My employer has certified maintenance on CoS and I also have sufficient funds to exceed the required £2700 level. My account has never gone below this level in past 90 days. Should I claim points for Maintenance Certified by Employer or my own funds? I'm thinking of claiming points for certified by employer and enclose my bank statement to make the case a bit stronger. Is this the right approach?

Q2. What evidence do I have to provide in case we go down maintenance certified by employer route?

Q3. I am claiming 30 points for CoS, Resident Labour Market Test completed. What documents do I need to enclose as evidence for this?

Your sponsor can only certify your maintenance. On your form you tick that the sponsor certified your maintenance. On the forms for your family they tick that they are showing evidence of funds.

You don't need any evidence to show your sponsor certifies your maintenance but if you are claiming points for this you better be sure they ticked the box on the CoS.

You don't need to show evidence that the RLMT was met. Your sponsor would have to show this when they get a visit from the UKBA. It's part of their duties.

Thank you for responding so quickly. If the sponsor certifies maintenance under Tier 2, they are automatically certifying maintenance for the main applicant as well as all dependants as described in paragraphs 524-528 of sponsor guidance.

From my experience. Your sponsor can certify Maintenance ( for you and your dependents ) only if they are A -Rated sponsors or Premium sponsors.. Next thing is they will add this as an additional comment ( in my case ) on the CoS. Also for RLMT, you employer will have to give an explanation why you don't need it or give details of job adverts in the sponsor management system.
