ILR Section 6 & 9 Help Please

Post by GordonFernandes » Sat Feb 16, 2013 6:50 pm

Dear Senior Members

I would please need some advice on my ILR which I would be applying on the 01/03/2013; mainly it is to do with Section 6 and Section 9

To give a background about my visa status:
HSMP stamped on the 09/10/07 was valid till 08/10/09 Tier 1 (General) extension 05/11/09 was valid till 05/11/12 I would have applied for ILR after this point but due the number of absences out of the country I was advised by a number of people to go for extension which I did .Here are the details of my extension.

Tier 1(General) 2nd extension 23/01/13 valid till 23/01/15

Break down of my absences:

Left UK Reached UK Total days Reasons

10-12-2007 26-02-2008 77 My wedding
10-12-2008 28-01-2009 48 Holiday
22-12-2009 13-02-2010 52 Holiday
17-03-2010 17-07-2010 121 Mum's Treatment
09-03-2011 03-04-2011 24 Holiday
01-10-2011 03-10-2011 1 Holiday
31-12-2011 22-01-2012 21 Holiday
05-07-2012 08-07-2012 2 Holiday

Q.1 (Section 6 --- 6.1)

When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.

My question here is should I key in 09/10/07 as this is the date my HSMP was stamped , If I key in this date then I would have to give all the details of my absences as mentioned above.
As I mentioned earlier I will be applying on the 01/03/2013 if you count backwards i.e. 5 years continuous stay from the date the application is made then it would be till 28/02/2008,does that means I will not have to give details of my wedding absences .IS that right

Q2 (Section 9)
Do I need to answer D1 and D2 after the new rules which have been passed on the 13/12/2012?
