I have offered sponsorship and ready to apply for Tier 2 General.
But having query about cooling period. Below is my case:
I have Tier 2 ICT issues in Aug 2011 for 1 year and Visa expired in Aug 2012.
However I have returned back to India in Jan 2012.
So now question is:
Am I eligible to apply for Tier 2 General. If I consider 'Cooling period' as 12 month from my last exit date i.e. Jan 2012 than my case is Valid.
But if (I hope not) cooling period start from last Visa expired date i.e. Aug 2012 than I have to wait till Aug 2013.

Can anyone clarify?
Cooling period starts from Last Exit date to today's date OR Last Visa expire date to today's date.

there is no cooling-off if you were not in the UK as a T2 migrant at any time during the 12 months immediately preceding the date of your application. However, you must provide evidence to show this.

I dont know what evidence but I can provide my P45 copy or stamp on my passport where I have returned date or may be email communications.
I hope it will work. do you have any idea on type of evidence.
