oci through grand parents?

Post by wpilr_nov12 » Mon Feb 18, 2013 12:13 am

My in laws are Indian citizens currently residing in India. My wife is not an Indian citizen currently because she renounced it after marriage. Are my UK citizen kids eligible for OCI? Otherwise it is costing us a fortune on tourist visas to India. I am a non visa national per Indian law. So is my wife. Please advise.

"because she renounced it after marriage"
so did she have an Indian passport before that? And have a surrender certificate for it? If so, your child can apply for OCI

A child won't get an OCI until one of the parents has it and it doesn't seem OP's wife has an OCI yet.

My wife did not ever have Indian passport - not required to travel into my country.

Both of us will be eligible for BC in Nov'13, and intend to acquire it. My country is not too fussy about dual citizenship.

Also, why would OCI be preferable to PIO for the children?
