ILR Eligibility date

Post by kksrirams » Tue Feb 26, 2013 6:44 pm

Hi,

Kindly advice on my ILR eligibility date. My details below.

Initial HSMP grant 18-Apr-2008 to 18-Apr-2010
Date of entry: 26-May-2008
Tier 1 extension 5-May-2010 to 5-May-2013

Am I eligible from 8th April (28 days before current visa expiration)
OR
21st March (28 days before initial HSMP grant)

Thanks

Since you entered within 28 days of your EC you can apply 28 days before the EC date so 28 days before 18th April.
Thanks!

Where can I find this rule in the BIA website?

I am in a similar situation with work permit start date of 13 April 2008 and entry date 4 May 2008. I booked an appointment for 7 April but it looks like I would have been eligible from 16 March if this is the case.

I will reschedule to an earlier date if still possible but would like confirmation of the rules.

I did not enter UK within 28(EC date-18Apr2008 Entry date-26May2008, approx 39 days) days of EC was it a typo and did you mean 90 days? Where can I find this info please? We (me & 2 dependents) are trying to apply before April-6 so we can save a fortune :-)

I believe it was a typo. See page 12 http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

The time between EC and date of first entry will be considered towards your ILR residence period, so long as you first entered the UK within 90 days of EC.
