My Tier 1 General visa for 2 years is expiring on 25 June 2013. To avoid the increasing fee, I want to apply for extension before 6 April 2013.
In-case if this extension is granted before my expiry date say 2 months before i.e. on 25 April 2013, the expiry date of this extended visa will be 25 April 2016.
Now, when I apply for ILR on 1 April 2016. My Tier 1 General visa will be shortfall by more than 2 months to be 5 years.
1. Is this 2 months shortfall be problem for later? Yes
2. Do the HO accepts application 3 months before the previous visa expiry date? Yes
3. Do I need to have 2nd time extension to cover up this shortfall? Yes
4. Can anyone clarifies me if I can apply for extension before 6 April with safe side in future? If you apply now to save money you will endup paying more in ur 2nd extention. So dont apply now an dapply when ur visa is expiring to prevent 2nd extention.
Even if you apply a day earlier it is same risk of shortfall so I will strongly suggest all to wait for your time and dont take any risk. But there are some circumstances where people came late into the UK and they are already short of 5 years of stay just like me. These people can apply early as it does not matter for them whether the visa officer issue visa from application date or expiry date. They have to go for 2nd extention any way. Last year in July I applied 3 months in advance of expiry of visa and the case worker renewed it from july. I came 3 months late, so already 3 months short of 5 years of stay in UK so took chance but not to avail. After extention I was 6 months short. so I am going again on early extention next wk to avoid fee increase. I hope you understands.jarus4045 wrote:Thank you Paba89 for your pinpoint answers.
1. This means that the HO will issue the visa (extension) from the date the decision was made disregarding the expiry date of the previous one.
Am I right?Might be, As you can see from the forum in PEO experience thread. Some people have recived extentions from expiry but that is solely on visa officer and there is a 50 50 chance. Why do u want to take a chance for few £100 which can make you pay way more if you have a shotage in 5 years. You never know next year the fee will be £100000000000000 for visa extention.
2. Now, one of my colleague has T1 General visa expiring on 25 May 2013. If he applies for extension before 6 April 2013, it will be 7 weeks earlier.
This will have similar risk as I have (2.5 months earlier extension and 7 weeks earlier extension has almost same consequences.Am I right?
