Tier 1 Extension due in April -UKBA held passport- Help PLZ

Hi All,

My family member Passport held by UKBA when he was arriving back to UK from holidays on Heathrow airport. Initially issued a "Liable to detain" letter but after few weeks issued another letter that he can work in the UK and carry on his job.

Now it's over 3 months and they're not responding the quires just mentioning that we've a backlog.

His Tier-1 is extension due in Mid April 2013. I was wonder what our options are? He's paying taxes without any problem and working full-time Permanent position in a FTSE 100 companies.

Can we still apply extension without Passport?
How to get passport back from UKBA?
What are his options are?


His Solicitor is not very helpful. We've been chasing him.

you can apply without the passport, just mention in the application form that passport is with UKBA citing any reference numbers/correspondence you received from them in the matter

What was the reason his passport was seized? Knowing this will help to give more insight into the case.

We're still not clear what's the reason. They interviewed him at airport, ask him to sit down after 4 hours gave him a letter "liable to detain" kept his passport. Letter instructed to report/sign-in every 2 week at nearest UKBA office. His solicitor has requested several time but they're not answer.
initially they ban him to work but after 3 weeks they removed it to resume his work.

Yes, we do have reference number provided by UKBA. Do we need any letter or anything?

Sorry, but i think you are not telling the story in full. They cant just seize someone's passport for no reason out of the blue, also banning someone from work and asking to report at UKBA is a very serious meansures which they undertake in certain cases.there must be a reason which they should have told you.


But in terms of answering your question, yes you just need to write a covering letter explaining situation with the reference number.

UKBA have no right to retain your passport.

I would suggest contact your local MP as matter of urgency and explain the situation.

Any border security force in the world retain your passport or identity documents if they believe they are forged.

I know of someone in a similar situation, im not trying to say it could be the same in this case but most probably the UKBA found out that the initial Tier1 application was done through a solicitor or adviser who has been blacklisted or jailed for immigration fraud.

That's not the case here. He applied at very first himself and it was approved. He also has very clean and good record while living here. We just don't know the right reason why he's in this situation. UKBA is not responding even for any query.

Can we know what were the crux of the questions they were asking him while they detained him at the airport? Didn't you have any clue regarding what they were referring to for his questioning?

You can mention the reference number as why you could not submit the passport while applying for extension. My friend didn't have passport ( lost and applied) but had to apply for extension, he got the extension on subsequently submitting the new passport. But his application was on hold till that time.

It's a little difficult to say that UKBA have no right to retain a passport when we don't know the reasons behind why they are doing it.

It could be that the UKBA believe the passport to be a forgery as you state, would be a reason for retaining it.

Chances are UKBA suspect the passport is a forgery or the person in question has used a form of deception in a previous application (knowingly or not)

If deception is used in previous application UKBA will not let him work at all and cancel his Tier 1 on the spot on airport.

UKBA only held your passport if forgery is in question.

He's a very clean record and a genuine Tier-1 worker. I asked him about questions which was mostly related to his Master degree and tax nothing else. Most of the questions for holidays. He's never breached any immigration or tax laws. like mention earlier, solicitor is trying to get in contact with UkBA but not getting any response. This is very concerning. I'm happy at least we can apply for tier-1 extension.
