Tier 1 Extension weird question

Post by DBAforever » Tue Mar 12, 2013 8:51 pm

Hi All,

This is for my friend...

My friend has submitted his Tier 1 Extension with family (4 dependents) in Dec 2012. He informed that he has downloaded an old form from the UKBA site which did not have any payment page, hence he hasn't provided payment details of any form. I know this sounds strange.

However he hasn't heard anything from UK Home Office yet. His questions to me are,

1. What does Home Office do for such cases ?

2. Can he submit a new form with payment page this time and a covering letter providing all his and his dependents details ?

Any help is highly appreciated.

Such an application would be returned/rejected as invalid by the UKBA. As 2-3 months have passed, I'm surprised that your friend has not yet received a letter to this effect, along with his supporting documents. Has he received any communication from the UKBA since he submitted the application in December? If he has a reference number, it would be best that he send the form again with correctly completed payment details, and a cover letter to explain the mistake made, asap.

It's unfortunate that he is only just now realising that he didn't submit his payment details - i.e. a rather long time has passed since he made the application.

1) Was his initial application made in-time? And
2) Does he still have valid leave to remain in the UK?

If the answer to either of the above questions is 'No', then he needs to act promptly.

Thank you so much for your reply cs95tdg.

Yeah even I was surprised when I came to know this. He just added that he phoned Home Office, but they said to him call after 6 months as they do not entertain any calls before the completion of 6 months (from the case has been filed).

To answer our questions,

1. Yes - He made his application well in-time.
2. No - I think the date was somewhere in Jan, which has passed.

I have asked him to start filling a new valid form and provide his bank details for fees with a covering letter.

Many thanks once again for your timely response.

In terms of the question you have raised here in this topic, 'No'. But the obvious point with Tier 2 applications is that they are employer sponsored, so he will need to meet the rules and requirements (with a CoS) of that immigration category when applying.
