ILR application and children

Post by collins10 » Wed Mar 20, 2013 11:06 am

I am planning to apply for ILR based on 10 years residency. I have two children one born in the UK (5 years old) and the other is now (8 years). the older child was born abroad in 2005. I still have visa till 2015 and so do the children. the children lived most of their lives here and they go to school since they were 4.

I was told that the UK born one can apply for British citizenship if my ILR is successful. but what should I do with the other child (Non uk born)? should I include her in my application for ILR or wait for my result and then apply for her.

Please advice me. I am confused.

Thank you

Dependants cannot be included in Long Residence applications. The children may wait.

What is the status of the children's other parent? Are you the children's mother or father?

Immediately after you are granted ILR, the UK-born child will be entitled to register for British citizenship.

The UK-Born child is fine and does not need ILR. However the child born outside needs ILR before he can apply for citizenship.

Thank you for your replies.
I am the mother. The father needs 1 year to apply for ilr based on 10 years as well. I read a few minutes earlier on this forum that I can apply under special section called 9.17 when I apply for naturalisation and the father is near applying for ilr

Is this true?
