Schengen Visa requirement with valid resident permit

Post by ad007008009 » Thu Mar 21, 2013 1:54 pm

Hello. I have a non-EU passport and usually would require to get a Schengen Visa. However, I have been working in the UK for a few years (now with a Tier 2) and am temporarily working in Germany and have a resident permit for the next 6 months.

Do I need a Schengen Visa to travel around Europe if I have a valid German resident permit? Some people have told me they don't think so, but they are not aware of the actual position.

Any help is much appreciated.

A national permit issued by a shengen state would be valid for other Shengen states.

Thanks, but all of the text there seems to refer to family members. I do not have any EU family members. My residence permit is a Work Permit.

I called the Swedish Embassy in UK and they said if I travel from Germany then I can enter Sweden but the same would not apply if I travelled from UK (regardless of my resident permit), which I found a bit strange.

Any thoughts?

If you read it closely, it also refers to a residence permit issued by a shengen state.

...holding a valid residence card issued by a Member State applying the Schengen acquis in full can also be exempted from the visa requirement under Article 5 of the Schengen Borders Code, see Annex 22

Germany and Sweden are in Schengen. The UK is not.

Thanks all.

The reason I wasn't sure whether p.90 of the attached doc in EUsmileWEallsmile's post above applied to my situation was because of the bold text below...
it should be noted that third country family members holding a valid residence card issued by a Member State applying the Schengen acquis in full can also be exempted from the visa requirement under Article 5 of the Schengen Borders Code, see Annex 22.
However, I sent a few emails to embassies/relevant persons and received the following responses, which confirms what EUsmile said.
Belgium Embassy in Germany wrote:I confirm that, since you are holder of a valid [third country] passport and of a valid German residence permit, you can travel to Belgium without visa and legally stay there for a time period of maximal 90 days within 6 months (as long as your German residence permit is valid).
VFS Helpline wrote:Please note that you can travel to Netherlands with the provided permit without any restrictions.
That's all very helpful. Thanks.
