Kindly help!! Immigration as Nephew

Post by raj » Tue Aug 31, 2004 12:42 am

Dear all,

1) I am an international student in UK who is about to complete the studies
2) I would like to know about SET (F) in which a dependent can get the ILR in UK based on their relatives sponsorship:
a) I have my uncle ( my mom's real brother) living in UK and a british citizen, as a nephew am I eligible for applying SET(F)
b) If yes, can I apply as student or I have to come to uk as his dependent first and then apply for this.
c) since my uncle already supported me financialy for my studies in UK, So it makes my case strong that i am dependent on him ( evidence-bank statements in which he sends monthly living expense to me)
d) how much time it will take to get this permission
e) if I will get this permission would I be having all the rights as a PR or british citizen
f) the rule says that dependent should not access to public funds otherwise it will be recovered from sponsor, could you please tell me for how long i cant claim public funds such as child benifits ( although I am unmarried as of now)
g) can i take any kind of job in UK

kindly respond at your earliest.

regds

Raj

I can see you are laying your eggs in several baskets (HSMP, Fammily sponsorhip?)

Any way, who looked after you before you came to the UK? dont you have any relatives back home?

Armed with your new UK degree - you have definately improved your chances of getting a decent job back home

Hi chess!!

ya its worth exploring all the available options as I have invested hefty amount of money in my education in UK.

I have my parents back home and they are now dependent on me since my father retired last year, I was earning pretty decent salary backhome and was leaving a very decent life, hence, I myself was supporting me. But now with this new investment on my education it has become the need of now to work and settle in UK.

Please help me with my above queries.

Raj,

Better stick to HSMP!

how about SEGS - do you qualify?.

IMHO, there are almost zero chances of getting a depedant visa in your situation

Not only zero chances. You will be booted out of the UK after HO receives your dependent application. Your student visa required you to leave the UK after you finish your studies.

I might agree with Chess but not with tnavon opinion. Yes, student visa says that i have to leave country after finishing my studies but then how come I could apply for staying as HSMP being an international student.

evantually may be my application as dependent get rejected but i cant be deported to back home as I can always stay in uk by extending my student visa/visitor visa for atleast a period of 6 months.

anyhow nothing to argue here but since it was a strong push from your side without any strong evidence that prompted me to respond.

NB:Chess i donot qualify for SEGS as my course is not listed.

cheers!!
