Naturalisation Time

Post by roza » Wed Mar 27, 2013 1:38 pm

Dear all. One more query.
Going to apply naturalisation on 05-04-2013 but i was on holiday on this date five years ago. Does it make any impact on residence requirement. My total period is 7 years all legal and just 25 holidays in april 08.
Got ILR 04-04-2012.
Thx and appreciated [/u]

The requirement is that you have to have been physically present in the UK exactly 5 years to the day on the date that the UKBA receives your application.

So if you were abroad on holiday on 7th April 2008, you will not have been present if they receive your application on 7th or 8th April 2013.

Is losing the fee for such a small issue worth the risk? I would apply later for when the time works after you had returned from holiday in 2008.

Hello Roza,

I submitted my application last week via NCS service and they did mention it very clrea that I must be in the country 5 years back on that particular date.
CR001 is absolutly correct.

I would say, its more risk then chance.

I was in exactly the same situation, called NCS to move my appointment to a later date, but the lady over the phone told me that no need to rebook the appointment as they will 'hold' my application until the date you were back in the UK (exactly five years ago).

So, best to speak to them. And, to be on the safe side just move your appointment to a later date.
