Hi All,

I need some objective input on my evidence that I have for my HSMP application, specifically the previous earnings evidence.

Firstly some background. I am a New Zealander living in the UK since september 2006 on a working holiday visa. I left NZ in August and travelled for 4 weeks. It took me a further 2 weeks to find a job in the UK. So the first question:

Can I prorata my NZ salary??


Here is the evidence

Age - 20 Points
- Original Drivers License
- NZ Citizenship Certificate
- Birth Certificate
- Notorised Copy of Passport

Earnings - 30 or 45 points between Jan 2006-Dec2006(depending if i can prorata or not)
- Original Contract with Employer
- Accountant's letter regarding tax returns
- Letter from NZ IRD, showing income tax returns
- Payrise Letter from CEO of company showing new salary
- Original Bank statements showing salary paid at fortnightly intervals
- 4 original payslips showing year to date pay and salary (we didnt get issued original payslips every pay period to save paper. This was the company policy. Payslips were only issued when something changed on the payslip, eg a reimbursement claim, holiday change, payrise etc, hence I only have 4 payslips for the period I am claiming for)
- Printed online copies of all payslips (signed by HR but NOT STAMPED).

Qualifications 30 points
- Original Degree certificate
- Letter from University

English Language Proficiency
- Letter from University


so my question here is if I should submit my application or not. Am I bound to get rejected since I do not have all origianal payslips and my duplicate payslips are not stamped and are not on letter headed paper.

I look forward to the replies.

You need to provide two clear evidence for annual earnings and they should confirm and verify each other. Other evidence help but if they reflect some months then the case worker is bound to get confused and application tends to go towards rejection.

The point is that if things are not clear, case worker rejects the application in general, as permitting people inside UK who aren't able to clearly demonstrate earnings etc. is not something HO wants.

You need to be advocate for your application. If you are not convinced, and cannot clearly provide two clear pieces of evidence, imagine a person(aka case worker), who does not know you and has to rely on the evidence provided. The benefit of doubt always goes against the applicant.

You case seems to be going towards rejection, so it would be a case of taking chance, if you apply.

the two pieces of evidence that I have is the bankstatements and my letter from the employer. Doesn't that help?

Also can someone please answer regarding pro-rata? Can I still pro-rata my earnings if I had a gap of 6 weeks between my NZ and UK jobs?

Yes you should clearly state which earnings you want to consider NZ or UK.
Further provide calculations for pro rata as well.

Yes you can show a gap of 6 weeks, and is fine. Clearly state that in your application.

Mine was a similar case India and UK with a gap of 1 month. I showed 8 months of India earnings and pro rated it.

I am claiming NZ salary and I have said this. however is do i need to show proof of a UK job?

no you don't need to show a UK job, that will be required for FLR(HSMP). Your UK salary slips/earnings are still required to verify you are in UK and earning or in a job and that your pro rata should be acceptable.

Dear Bulldozer,

I can see that yours is a genuine case with sufficient documents to support. However, you should remember to keep your evidences simple and to the point.

Follow the following steps :

a/ for age proof, just provide EITHER Birth Certificate or Full driving license as the evidence. Make sure these are in English language.

b/ For past earnings, the salary slips with sign AND Stamps are a must. Dont compromise on this.

Further, You must provide income tax returns

Any other documents if you wish to show, make sure that it is consistent with the above two (IT returns and salary slips). If any discrepancy is found, your application is likely to be rejected.
