Apply for fiance visa if appeal is refused

Hello everyone,

My Tier 1 entrepreneur visa has been refused and I have appealed. If my appeal is not allowed, can I apply for a fiance visa from the uk, if yes how do I go about this, and I am scared if the Ukba will see this as an attempt to extend my stay here.

Any thoughts will be appreciated.
